A letter from the applicant is attached. Also attached is a definition of Special Home Occupation from Section 35-900 and the standards for Special Use Permits found in Section 35-220. A public hearing has been scheduled and the neighboring property owners have been notified of the meeting. The Building Official has inspected the applicant's home and reports that, with respect to code related concerns, there should be no problem. The Commission should clearly determine, in discussion with the applicant, that the restrictions on parking, number of outside employees and hours of operation shall be met. The key consideration in any Special Home Occupation is a determination that the proposed use is clearly secondary and incidental to the primary use which is residential. The following conditions of approval are suggested: 1. Permit is issued to the applicant as operator of the proposed use and is nontransferable. 2. The permit is subject to all applicable codes, ordinances and regulations and violation thereof shall be grounds for revocation. 3. Hours of operation shall be: 6-15-78
