PROCEDURES AND REQUIREMENTS FOR FILING APPLICATION FOR SITE AND BUILDING
PLAN APPROVAL
Prior to submission of an application for plan review and approval, prospective
applicants should arrange an informational meeting with the Planning Staff to
discuss preliminary plans and to become familiarized with applicable ordinance
and policy provisions.
Three (3) copies of the following documents and information shall be submitted,
at least 14 days prior to the date of the regular Commission meeting, concurrent
with filing the application (required documents must be consistent with ordi-
nance and policy provisions before an application may be accepted):
1. A certified site survey drawing by a registered engineer or land surveyor
showing pertinent existing condition, accurately dimensioned.
2.* An accurately scaled and dimensioned site plan indicating:
a) parking layouts including access provisions;
b) designations and locations of accessory buildings;
c) fences, walls or other screening, including heights and type of material;
d) outside lighting provisions, type and location;
e) curbing.
3.* A landscape plan showing areas to be sodded or seeded; location, size and
species of trees and shrubbery.
4.* Building floor plans, elevations, sections and specifications, including
materials proposed.
5.* Existing and proposed land elevations, drainage provisions, and utility
provisions.
6. Additional drawings, plans or information deemed necessary by the Secretary.
*Must be prepared by a registered architect or person registered with the State
Board of Registration for Architects, Engineers and Land Surveyors, and said
drawings/plans shall be so certified.
NOTE: Upon approval of plans by the Council and prior to issuance of permits,
a Performance Agreement as to approved site improvements and a supporting finan-
cial guarantee, in an amount to be determined by the City, are required. Accept-
able financial instruments include cash escrow; certificate of deposit; and
performance bond.
Copies of the Zoning Ordinance may be obtained from the Administrative Office.

Applicant: Lombard Properties,
Location: Northeast of LaBelle's
Request: Preliminary R.L.S. (Registered Land Survey)
The applicant requests preliminary R.L.S. approval to combine into a single tract
the three parcels of land immediately northeast of LaBelle's at the intersection of
Summit Drive and Earle Brown Drive. The property in question is zoned C2 and is
bounded on the northeast by ummit Drive, on the southeast by Earle Brown Drive, on
the southwest by LaBelle's, and on the northwest by the site of the proposed Target
store. The purpose of the combination is to create a single parcel for a retail
strip shopping center.
The existing legal description of the property is Tracts G, H, and I of R.L.S.
1325. The new legal description will simply be Tract A of an as yet un-numbered
R.L.S. The area of the proposed Tract A is 281,276 sq. ft., or 6.46 acres.
The proposed plat shows no easements of any kind. However, if a joint access
arrangement can be worked out with Target and LaBelle's, there may be easements for
cross access applying to this property, though most of the driveway space is on
Target and LaBelle's properties. There is also the possibility that a future off -
site parking arrangement for Target employees may be worked out and the necessary
encumbrance placed on a portion of this property. The details of these arrangements
will become clear when a site and building plan is submitted for a retail center on
this property.
The preliminary R.L.S. is acceptable and approval is recommended, subject to at
least the following conditions:
1. The final R.L.S. is subject to review and approval by the City
Engineer.
2. The final R.L.S. is subject to the provisions of Chapter 15 of the
City Ordinances.

This letter is in response to Lombard Properties' request for authorization to do soil
correction and site preparation work in addition to some utility work consisting of
store sewer construction in the boulevard right-of-way area along Summit Drive. The
site in question is approximately 6.5 acres in area and is located along the south-
westerly side of Sur.imit Drive and is bounded by Summit Drive, Earle Brown Drive, the
LaBelle's store and the Target property. Currently, the site consists of three con-
tiguous parcels described as Tracts G, H and I, R.L.S. 1325. You have indicated that
it is anticipated that approximately 20,000 cubic yards of material are to be exported
from the site with 20,000 cubic yards of fill material to be brought in in conjunction
with the proposed work.
Although amended site and building plans for a shopping center have not yet been sub-
mitted for Planning Commission and City Council review and approval, nor has a proposed
registered land survey combining the three parcels into a single parcel been given
final approval and filed, we are prepared to authorize limited work on the site. Please
be advised -that you are hereby authorized to commence the soil correction, site prepar-
ation and limited utility work subject to the following conditions and considerations:
1. A street patch/boulevard restoration agreement and a financial guarantee
in the amount of $1,000.00 shall be submitted to the Brooklyn Center
Engineering Department prior to commencement of the work.
2. This authorization does not imply, nor authorize any activity other
than the soil correction, site preparation and limited utility work
proposed. No construction requiring a building permit may commence
unless and until final approval of the R.L.S. has been granted by the
City Council and it has been filed with the County; the amended site and
building plan has been reviewed and approved by the Planning Commission
and City Council; and the proper permits have been issued.
3. This authorization does not commit the City to a future acceptance of the
work done, or the soil conditions created. These matters will have to be
addressed at the time plans for construction of the building are reviewed
and approved.

4. Access to the site for construction equipment and hauling shall be limited
to Summit Drive. The curb along Summit Drive, where access to the site is
to be gained, shall be bridged to avoid breakup.
5. If construction of the proposed shopping center does not conmence by May
15, 1986, Lombard Properties, Inc. shall be responsible for providing on
the site a quick growing cover such as rye grass or other suitable mater-
ial (including top soil, if necessary) in order to control dust.
6. Lombard Properties, Inc. and its agents are responsible for establishing
an on -site drainage pattern that will prevent any public safety problems
such as deep pockets that allow standing water or large unprotected holes
during the time of this operation.
7. Lombard Properties, Inc. and its agents acknowledge full responsibility
for correcting any drainage problems or interference with the natural
watershed that may result because of this operation.
8. Lombard Properties, Inc. and its agents acknowledge full responsibility
for daily cleanup of spilled materials on City streets and the immediate
removal of any material from City streets that may constitute a traffic
safety problem.
9. Any dewatering of the site done in conjunction with this activity shall
be in conformance with existing State and local regulations, including
the obtaining of any permits from DNR, if necessary.
