of the area northerly and easterly of Sumn.it Drive 4! lJong Er: -le Brown

The R.1, S . comprehends 8 tracts, including Earle Srown Drive which
is being realigne6. The application is subatit:ted in response to the
ar_ +roval. cone.t.tions of Application No. 74004,
The Director of 'Aiblic Vorks will be prepared to cormaent on the
Proposal. in detail.
�- Xn conjunction with this application, there is a pending matter
involving the site layout for the Office :Power 11 and the possible
ramifications of an upgrading of 94 and T.F. 100.
The matter was discussed extensively at the Apri 4 18, 1974 meeting.
The Conunission discussed a proposed agreement be when B.C.X.P. and
the Cite which sets .forth various options relatile to providing adequate
park.ina for the sites in this area (particularly Office} 'Tower 11 Phases
X and Lri) in light of possible acouisi tide of a porction of the land by
the Sighway Department.
'Vhe Commission's consensus was that covenant, expressing the teens
of the agretment, should be prepared and submitted for review. The
intent would be to file the approved covenant upon the titles of the
subject parcels to assume chat the agreement would ,tarry with the
properties, regardless of Q`anershia.
We have prepared such a document: and we will be prepared to discuss
it in detail.
In this context, Kryn will also be prepared to discuss certain ni-Le
amendments to Plano approved under Application Not 74004, involving
possible deferment: of some reauired parking spaces.

A covenant, setting forth certain conditions regarding
she provision for required parking faciliti.ns for deveioP--
ments on Tracts "D" and "F", shall be filed, as approved
by the City Council, with the t3 tl.us of. those tracts in
conjunction with filing the final_ R.L.S.
AGREEMENT BETWEEN THE CITY OF BROOKLYN CANTER AND THE
BROOKLYN CENTER INDUSTRIAL PARK, INC., RELATIVE TO
OFFICE TOWER PROJECT PARKING
THIS AGREEMENT entered into this 17th day of June, 1974, between
the City of Brooklyn Center, a municipal corporation under the laws of
Minnesota, hereinafter referred to as the "City", and B ooklyn Center
Industrial Park, Inc. and Tropicana Holding Company, t, eir heirs and
assigns, hereinafter referred to as the "Owner". It is ilntended that the
term "Owner" shall apply to subsequent or part owners.
WHEREAS, the Owner holds title to certain property within the City
of Brooklyn Center, County of Hennepin, described as follows:

Tracts D and E of R. L. S. No. 1380
WHEREAS, the Owner is constructing an office tower project on the
above described property; and
WHEREAS, the said office tower project is proposed to be constructed
in Phases I and II; and
WHEREAS, Phase I of said project overlying Tract E of said R. L. S.
consists of a 7-story office tower and a connecting link co4taining mechanical
equipment for the use of the Phase I building and the proposed Phase II 5-story
office building to be built on Tract D of said R. L. S. ; and
WHEREAS, the Minnesota Highway Department has released preliminary
plans .for the realignment and reconstruction of the Humboldt Avenue-T. H. 100
and F. I. 94 Interchange which, if implemented, would result in the loss of
approximately 2 acres of land from Tracts D & E of said R. L. S. along the
present trunk highway right-of-way; and
WHEREAS, the certainty and timing of said highway realignment is
speculative at this time; and

WHEREAS, the City Council has required that the Owner provide the
currently required parking for said project on property �ther than the potential
highway right-of-way land; and
WHEREAS, the Owner has submitted to the City parking lot survey
prepared by Bathe r-Ringrose-Wolsfeld, Inc. , of actual arking experience at
four comparable building sites in the Twin Ctiy area in support of a modifica-
tion of the present City parking ordinance requirements;) and
WHEREAS, revised parking standards as suggested by said survey would
result in a need for fewer parking spaces for said proje t to the extent that
adequate parking could be provided for Phase I on Tract E of said R. L. S. ,
excluding the said potential highway right-of-way land; and
WHEREAS, the Owner has requested approval from the City Council to
utilize a portion of the said potential right-of-way to meet the current ordinance
provisions for parking requirements for phase I, so that the Owner can maxi -
Mize the land use and minimize the cost of mortgage release paymnts for PhaseI;
THEREFORE, IT IS AGREED between the parties hereto as follows:
On or before submission of plans for Phase II or other development of
Tract D, R. L. S. No. 1380, the Owner proposes to provide parking which meets
then current parking standards for Tracts D & E of R. L. S. No. 1380. The
alternative solutions to the various possible situations are as follows:
1. Phase I will be constructed in accordance with amended plans
for Application No. 74004 as approved by the City Council on
June 3, 1974, if one of the following situations occurs:
a) the Minnesota Highway Department adopts a highway
realignment plan which does not interfere with proposed
parking on the approved plan, and the City adheres to
its present parking standards; or
b) the City of Brooklyn Center adopts ne1.v reduced parking
standards substantially in accordance with the survey
recommendations, even though the highway realignment
occurs as presently contemplated.

2. The Owner will be obligated and hereby agrees to provide required
parking for Phase I either by :
a) adding sufficient land area from Tract D, R. L. S. No. 1380
to provide the required spaces; or
b) constructing an approved parking structure on Tract E of
said R.L.S. ,
if the City does not reduce its parking standards Ld the Minnesota
Highway Department does not abandon the proposed highway realignment
plans.
