Dear Sir:
I hereby make application to open on May 6, 1975, the Penthouse Courts,
8th floor of 6120 Earl Brown Drive as a handball and racquetball club.
The hours would be from 7:00 A.M. to 8:30 P.M., Monday through Saturday.
We would sell memberships to both men and women players with a minimum
age for application of 18 years old.
During the past six years I have been Executive Secretary and Manager
of The Kings Court Handball and Racquetball Clubs in Edina and Rose-
ville. Previous to this I worked for The Village of Edina in various
capacities. Enclosed is a resume of my responsibilities at each place.
Also included is a letter we intend to send out to prospective members
regarding our fees and hours.
I would also like permission to sell a minimum of merchandise which
would include handballs, racquetballs, supporters and socks.

PENTHOUSE COURTS
RULES AND REGULATIONS
* Membership is restricted to persons 18 years of age and older.
* Membership cost is $10.00 per month. (free month after 11
consecutive paid months)
* Court fees: $1.50 per hour per person. Maximum for doubles
will be $5.00 per hour. Players are responsible for vacating
the court when their hour is up.
* Guest fees: $1.00 per visist plus court fees and must be
accompanied by a member.
* Use of exercise equipment is free to members and their guests.
* Court hours: First reservation will be at 7:00 A.M. and the
last reservation will be at 7:30 P.M., Monday through Saturday.
* Reservations may be made one day in advance, but no sooner.
Reservations must be cancelled at least two hours in advance if
unable to show at the reserved time. If the court is not
cancelled a $3.00 charge will be imposed.
* Smoking in the lounge area only.

On December 9, 1974, the Council approved a special use permit
for an "Athi.etic Club;n as requested by B.C.I.P. The Facility
is located on the eighth level of the recently corig3l :teU Earle
Broldn Office `dower.
Conditions of the approval were:
1. The Special Use is subject to all applicable ordinance
requirements and violation thereof shall be grounds
for revocation of the penitit.
2. The occupancy load of the eighth floor at any given
time shall not exceed 200 persons.
3. Retail sales actk,,rJties are prohibited e:ycept for
those normally found in office buildings, such as
vending machines and the like.

The applicant seeks permission to conduct an "Athletic Cl.ub°t an

A public hearing has been scheduled.
The handball courts, sauna, exercise room and san ta.ry facilities
were approved up -der the s.- to and building plan approval, as tiacy

Concerns include
1. Control of the occupancy load (capacity) of the proposed
public facility. The applicant has advertised that

Regarding site and building plans, our primary doncernn have
fen:
1. Site access and desic�s�_ The arplicar.t: has worked with
the T;c�gineerir3cl Department in developing an extension
of Earle Brorvjr- Drive i.nclydi.ng a cul - e-var, turn around.
The 10.6 acre: site has been laid out lAithin the boundaries
comprehended by the proposed future realignment of the

Two access points are comprehended off of Earle Brogan

The applicant has also developed drainage ar..d utility
