Request: Special Use Permit
The applicant is seeking a Special Use Permit to operate a health and athletic
club in the facilities on the top level of the high-rise office building. The
nature of the facility is described in the attached letter.
Athletic clubs are special uses in the C-2 and I-1 Zoning Districts.
Two nontransferable special use permits for comparable activity have been issued
to this property since it was built in 1974. Neither operation was commercially
successful. The facilities, including racquet ball courts, were originally com-
prehended to serve the occupants of the building for a variety of lease -related
reasons. The building management elected to have a facility available to the
general public. This applicant represents the ownership of the building (unlike
the two previous applications which were submitted by vendors who had similar
operations in the Twin Cities).
The primary concerns voiced by the Planning Commission and City Council on the
other applications involve the maximum occupancy of this eighth floor area,
hours of operation and limitations as to any retail sales.
A public hearing has been scheduled.
Approval would be subject to the following conditions:
1. The Special Use Permit is issued to the applicant as operator
of the facility and is nontransferable.
2. The Special Use Permit is subject to all applicable ordinances,
codes and regulations and violation thereof shall be grounds
for revocation of the permit.
3. The occupancy on the eighth floor at any given time shall not
exceed 200 persons.
4. Retail sales shall be limited to items clearly incidental and
related to the operation of the facility and other sundries
normally found in office buildings such as tobacco, beverages,
and candy.

PERFORMANCE AGREEMENT
This agreement is entered into by Sheehy Construction Co.
First Party, to the City of Brooklyn Center, a municipal
under the laws of the State of minnesota, Second Party,
corporation,
as follows:
The Council of the City of Brooklyn Center has approved(pur-
suant to City Ordinances) the development: plans of the First Party
subject to the execution of this performance agreement. In consid-
eration of such approval, the First Party (and its heirs, successors
or assigns) does covenant and agree to perform the following obli-
gations on the property known as 6120 Earle Brown Drive
"The paving of parking and driving areas with 2" hot -mixed bituminous
mat installed over a suitable base; installation of poured -in -place
concrete curbing along the perimeter of all parking and driving areas,
utilizing MHD B-612 design, except for those areas approved by the City
Council as deferred; screening of all mechanical equipment located on
the roof and of any outdoor trash disposal facilities; installation of
grass sod, trees and shrubbery or other vegetative materials in areas
not otherwise improved, including sodding in the area between the
property line and the curbline of the adjacent street, except for those
areas approved by the City Council as deferred; required irrigation
system; drainage and utility provisions as approved by the City Engineer;
subdivision of the subject site and area as required by the City Council
approval; and, all other site improvements described on the plans

Firsts Party u iders ands t11aE' e ap pr6val by the City Council is
further subject to the furnishing of a "per-^rmance bond" or "cash
escrow" determined by the City Manager in the amount of $ 70,000.00
to guarantee the First Party's performance of the foregoing obliga-
tions. Further, the First Party agrees that the initial installation
of the site improvements shall be completed on or before 3/l/75

and that the monetary bond (or a part thereof) may be retained by the
City for an additional period up to _ 3/1/76 _, to guarantee
the maintenance of the items initially completr_d tinder this agreement.
A copy of this undertaking shall be attached to the corporate
surety bond and reference to this undertaking shall be made in such
bond, so that no corporate surety shall assert as a defense any lack
of reference in the bond to these undertakings.
Wherefore, the undersigned First Party have set their hand this
8th day of March 1974
