INFORMATION ,SHEET
Application No. 65069
Applicant: Edmund Pendy
Type of Request: `variance from Section 35-401 and 35-402 which requires
a 10 foot side yard setback., to allow construction of
a 12 foot addition to the east side of the house.
Property: 5916 Ewing Avenue North
Lot 1 3lock 2, Pearson` s Northport Third Addition
Owner of Property: Edmund Pendy
Background- None
Points to be Considered;
1, it has not been proven that. the addition would, when completed,
be 8 ft, from the property line. This would have wo he shown
to the Building Inspector before construction commenced.
23 ThIs house and the one ;text to it (owned by Gross of Glory Chruchj
are the only ones in the block, and are surrounded by street
and open parking lot.
Staff Comments:
1) if acting in accordance with the standards for varfan►,es set out
in Section 35-221 ; this application would fail on two points
enumerated therein; they are:
"1. Because of the particular ph;,vsf.cal surroundings,
0ape or topographical conditions of t e specific parcel.
of land involved, a particular hardship to the owner
would result, as distinguished from a raere inconvenience„
if the strict letter of the regulations were to he carried
out; 4. The alleged difficulty or hardship is -aused
by the provisions of this ordinance and has not been
created by any person peresently or formerly bavincg an
interest in the parcel of land;"
The configuration of the ;and has nothing to do with any bardship
existing; It is due to the facia that Mr. Pend; ',cis a hirge family
and needs a larger Home

Staff Comments, (Cont'd)
2) Although Mr, iPendy's application fails on the two points
stated above, his proposal is not in conflict with the
other four standards for variances set out in. Section 35-221.
Perhaps the necessary variance could be based on the
uniqueness of the situation, where this home and the
neighboring one are the only ones on thQ block, and the
purpose of the ordinance (adequate tight, air, etc,) will
not be subverted by allowing this encroachment
