Location: 5001 Drew Avenue North Request: Parking Plan Approval This item was considered at the March 9, 1978 meeting and reference is made to the ritnutes°which contain information relative to the proposed use. The item was tabled so the applicant would have the opportunity to prepare and submit revised site plans and so we could contact the property owner to the north relative to the matter of screen fencing between the properties. We contacted that neighboring property owner last week and reviewed the proposed site plan. We also reviewed that owner's six ft. opaque fence which extends the length of his property,and we discussed the applicant's request to defer install- ation of the ordinance required opaque fence within the 35 ft. buffer greenstrip which he proposes to install. The neighboring property owner welcomes the proposed upgrading of this corner and agrees that since the screen fencing is intended to protect his property from the commercial use, there would be little benefit gained at this time with the construction of another opaque fence adjacent or parallel to his. The owner was particularly appreciative of the fact that the proposed use is much less intense than the service station use which has been characteristic of the corner property for almost 20 years. We also suggested to the applicant that he contact the neighboring property owner relative to possible joint informal agreement as to maintenance and upkeep of the existing fence. We propose this not as a formal requirement, but rather as a "good neighbor" gesture. It is recommended that a condition of this approval include a requirement that the owner of the commercial property execute an appropriate agreement with the City to be filed with the title of the property; the agreement would specifically acknowledge the ordinance requirement for providing an 8 ft. opaque fence or wall to screen the commercial use from the residential property to the north, should the existing fencing be removed. Approval would be subject to the following: 1. Site grading, drainage, and curbing plans are subject to approval by the City Engineer. 2. Existing underground fuel storage tanks shall be removed as directed and approved by the Building and Fire Officials. 3. A Performance Agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted to assure completion of approved site improvements. 4. The property owner shall execute an agreement, as approved by the City, acknowledging the ordinance requirement for an 8 ft. opaque fence within the required greenstrip to provide screening of the commercial use from the single family residential properties to the north; and said agreement shall be filed on the title to the property. 3-23-78
