Overmyer Warehouse Co. corner of France Avenue North Street (extended Westerly) The undersigned company is purchasing a tract of land at the above described location from Tri-State Land Company, a Minnesota corporation. The purchase agreement, dated February 8, 1965, with Tri-State Land Company on page 7, paragraph 10(c), provides that Tri-State Land Company has the right to dedicate the South 33 feet of the parcel being acquired by the undersigned together with a small additional parcel in the Southwest corner of said parcel to the public for public road purposes. The undersigned wishes to restate this understanding as set forth in said purchase agreement to the Village Coun- cil of Brooklyn Center so that there will be no question of the rights of Tri-State Land Company as against the rights of the undersigned, to make such dedication of said tract as specifically described in the purchase agreement. Said tract is shown on a survey of the parcel made by Egan, Field & Nowak and dated January 4, 1965, as a "reservation for 33 foot nonexclusive, private right-of-way for street purposes."
