P.:ior to submission of an application for plan review and approval, prospective
licants should arrange an informational meeting with the Planning Staff to
cz 'icss preliminary plans and to become familiarized with applicable ordinance

1. A certified site survey drawing by a registered engineer or land surveyor
showing pertinent existing condition, accurately dimensioned. --

^CTL: Upon approval of plans by the Council and prior to issuance of permits,
a Performance Agreement as to approved site improvements and a supporting finan-
cial guarantee, in an amount to be determined by the City, are required. Accept-

performance bond.

Location: County Road 10 and Brooklyn Boulevard
Request: Preliminary Plat
The applicant requests preliminary plat approval to divide into
three lots the land at the northeast corner of County Road 10 and
Brooklyn Boulevard on which the Brooklyn Crossings office Develop-
ment is being constructed. The land in question is bounded by
single family homes on the north, by Brooklyn Boulevard on the
west, by County Road 10 on the south and by Northway Drive and
the F & M Bank site on the east. The existing leg 1 description
of the property is Lot 1, Block 1, Brockdale 2nd A dition. The
proposed legal description is Lots 1, 2 and 3, Blo 1, Brooklyn
Crossing Addition. The total land area of the pla is 325,349 sq.
ft., or about 7.5 acres. The proposed lot sizes a as follows:
Lot 1 136,598 sq. ft. 3.14 acres
Lot 2 158,891, sq. ft. 3.65 acres
Lot 3 29,860 sq. ft. 69 acres
Block 1 325,349 sq. ft. 7.48 acres
Lot 1 is located at the northeast corner of County Road 10 and
Brooklyn Boulevard, but has no access off these streets. A 30'
wide easement through Lot 2 for ingress and egress is, therefore,
proposed. Lot 2 is bounded by Northway Drive on the southeast.
All access to the development will be off Northway Drive. Lot 3,
at the northeast corner of the development will contain a smaller
(approximately 6,000 sq. ft.) office building and also has no
separate access. A 24' wide access easement to this parcel is
proposed.
One concern raised by the proposed plat is the distribution of
parking among the three lots in relation to the three separate
buildings. The respective parking requirements and proposed stalls
are listed below:

Based on this parking plan, ordinance requirements for the develop-
ment and for each building are met.
By platting each building into a separate lot, the north property
line becomes a rear property line for Lot 3 instead of a side in-
terior property line for the entire development. As a result, the
setback for building C, the small 6,000 sq. ft. office building, is
increased from 15' to 40'. A revised site plan has been prepared
for this area which changes the shape of the building so that it
conforms with the rear yard setback requirement. The revised plan
also eliminates any separate access to Lot 3. A co dition of the
original site and building plan approval was the el mination of
such an access and reliance on access through Lot 2 and/or the
F & M Bank site. An alternate plan has been prepared which utilizes

joint access with the F & M Bank in the event negotiations with
the bank are successful in working out such an ariangement.
In general, the plat seems to be in order and approval is recom-
mended, subject to at least the following conditions:
1. The final plat is subject to approval bythe
City Engineer.
2. The final plat is subject to the provisions of
Chapter 15 of the City Ordinances.
3. The final plat shall be filed at the Cou ty prior
to issuance of building permits for buil ing B or C.
4. Easement documents concerning access to of 1 and
Lot 3 shall be approved by the City Atto ney prior
to final plat approval.

street and utility purposes. As described in the enclosed serent docLment,
the easement location is the northerly seventy-five feet of I�ot 22, Gould's
Riverview Addition which lies within the northerly extension of Colfax Avenue
North. The City requests you modify the easement to allow for utility installa-
tion within the easement area by making the two corrections shown on the enclosed
document.
It is also requested that three (3) copies of the executed casement docZmlent be
forwarded to our office for filing with the County.

KNOW ALL MEN BY THESE PRESENTS, that Northern States Power Company, a
Minnesota corporation, hereinafter called "Grantor", does hereby convey unto
the City of Brooklyn Center, a municipal corporation under the laws of the
State of Minnesota, its successors and assigns, for the use and enjoyment of
the general public, an easement for public road purposes over, and across the
following described property located in the County of Hennepin, State of
Minnesota, to -wit: r
That part of the North 75 feet of Lot 22, Gould's
Riverview Addition according to the recorded plat
thereof on file and of record in the office of'the
County Recorder in and for Hennepin County, wh ch
lies between the Northerly extensions through aid
Lot 22 of the East and West boundary of Colfax
Avenue North.
Subject, however, to the provisions hereinafter specified, compliance
with which constitutes the sole consideration for the easement herein granted:
1. The above property constitutes a part of Grant is transmission line
right of way and the grade of the road to be established thereon shall not be
altered to the extent that the minimum clearance between the electrical conduc-
tors suspended thereover and the surface of such road shall become less than
that specified in the National Electrical Safety Code and, in the event of such
alteration of the grade of such road, Grantor shall be compensated fully for all
expenses it incurs in re-establishing such minimum clearance.
2. There shall always be maintained, on both the Easterly and the
Westerly sides of the traveled way of such road, adequate approaches to allow
Grantor easy access to the remainder of its said transmission line right of way
from such road.
IN FITNESS WHEREOF the said Grantor has caused this instrument to be
duly executed this day of 1981.
