Service station location variance
The applicant is requesting a variance from Section
35-414 A. of the Zoning Ordinance whit-b requires that
a service station must front on a street designated as
thoroughfare. The site location for the proposed
service station is on the perimeter road in the interior of
th.e Brook.dale Center complex and does not meet this
requirement.
ANALYSIS KM RECMMIDWAMON
It would appear that strict enforcement of the literal
provisions of this sections of the Zoning Ordinance would
cause an undue hardship to the applicant because the
location of the proposed service station is in the interior
of the Brookdale Center property and therefor unique to
that property
it is therefore recommended that the variance be granted
because the locations of the service station is unique
to that property and is a situation which is not generally
common to other properties within the same zoning classification.
