Member Kay Lasinan introduced the following resolution and moved its adoption: RESOLUTION NO. 20 -1-0-75 RESOLUTION REGARDING THE DISPOSITION OF PLANNING COMMISSION APPLICATION NO. 2010-004, A REQUEST FOR PRELIMINARY PLAT APPROVAL OF NORTHWEST FAMILY SERVICE CENTER WHEREAS, Planning Commission Application No. 2010-004 submitted by the Welsh Construction, on behalf of CEAP, Inc. and Independent School District 279 requests Preliminary Plat approval of a subdivision, to be known as Northwest Family Service Center, a replat/consolidation of Lot 1, Block •1, Center Brookdale Addition (R- 1 residence/vacant lot), Lot 4, Block 1, Replat of Block 2 Lang Addition (R-1 residence/vacant lot), and Lot 3, Block 1, Osseo Willow Lane Addition (C-i Adult Ed Building) into a 3.9 acre lot with right of way dedications to facilitate improvements to the 71st Ave. North; and WHEREAS, the Planning Commission held a duly called public hearing on March 25, 2010, which was continued until April 12, 2010, at which time a staff report and public testimony regarding the preliminary plat of Northwest Family Service Center were received; and WHEREAS, the Planning Commission finds that the Preliminary Piatis consistent with the General Development Plans of the Northwest Family Service Center Planned Unit Development; and WHEREAS, the Planning Commission recommended approval of Application No. 2010-004 by adopting Planning Commission Resolution No. 2010-01; and WHEREAS, the City Council considered ApplicatioñNo. 2010-004 at its April 26, 2010, meeting, considered the Preliminary Plat in light of all testimony received, and the Planning Commission's recommendations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to approve Application No. 2010-004 submitted by Welsh Construction in consideration of the following: 1.The final plat is subject to review and approval by the City Engineer Department as outlined in their memo dated April 13, 2010. 2.The final plat is subject to the provisions of Chapter 15 of the City Ordinances. RESOLUTION NO.2010-75 3.Appropriate cross access agreement allowing access from the Willow Lane Early Childhood and Family Education Center, the Northwest Family Service Center, and the Willow Lane Apartments to the proposed Lot 3 shall be developed and filed with the plat. 4.The necessary drainage and utility easements within this Plat and the PUD Master Plan, as approved by the City Engineer, shall be dedicated and filed with the final plat. 5.Existing, but no longer necessary, easements shall be vacated by the City prior to release of the final plat. 6.Approval of the access improvements to the entrance onto Brooklyn Boulevard and the 71St Avenue signalized intersection by Hennepin County. • 7. Approval of the 71st Avenue street realignment project by the City of Brooklyn Center. WHEREAS, Planning Commission Application No. 2010-006 submitted by Welsh Construction, on behalf CEAP, Inc. and Independent School District 279, are requesting site and building plan approval for Phase Hof the Northwest Family Services Center; and WHEREAS the 2nd phase development includes the construction of a 63,362 sq. ft. addition to the Adult Education Building, located at 7051 Brooklyn Boulevard, a three story parking structure, the redesign of access and internal movement within the parking lot of the Willow Lane Early Childhood Family Education Center located at 7020 Perry Avenue, and access improvements to the signalized intersection of 71 " Avenue North and Brooklyn Boulevard; and WHEREAS, the Planning Commission fmds that the Site and Building plans are consistent with the General Development Plans of the Northwest Family Service Center Planned Unit Development; and WHEREAS, the Planning Commission recommended approval of Application No. 2010-006 by adopting Planning Commission Resolution No. 2010-02 on April 15, 2010; and WHEREAS, the City Council considered Application No. 2010-006 at its April 26, 2010, meeting. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to approve Application No. 2010-006 submitted by Welsh Construction in consideration of the following: 1.The building plans are subject to review and approval by the Building Official with respect to applicable codes prior to the issuance of permits. 2.Grading, drainage, utility and erosion control plans are subjectto review.and approval by the City Engineer prior to the issuance of permits. 3. Any outside trash disposal facilities and/or roof top mechanical equipment shall be appropriately screened from view and provided with opaque gates, -consistent with Chapter 35-411. Plan approval is exclusive of all signery which is subject to Chapter 34 of the city ordinances. 9.All work performed and materials used for construction of utilities shall conform to the City of Brooklyn Center's current standard specifications and details. 10.The applicant shall enter into an easement and agreement for maintenance and inspection of utility and storm drainage systems prior to the issuance of permits. 11.The applicant shall provide appropriate erosion and sediment control devices on site during construction as approved by the City Engineering Department. 12.The final plat comprehended under Planning Commission Application No. 2010-004 shall be approved by the City Council and filed with Hennepin County prior to the issuance of occupancy permits for this project. 13.The rezoning comprehended under Planning Commission Application No 2004-005 shall be approved prior to the issuance of building permits for the project. 14.Access to the site along Brooklyn Boulevard is subject to approval by Hennepin County Transportation Department and the obtaining of the appropriate permit. 15.The public improvements for the realignment of 71st Avenue North and the signalized - intersection are approved and installed with or simultaneous with this project. 16.Approval is subject to conditions and recommendations as outlined in the City Engineering Department's memo dated April 13, 2010. I have reviewed your submittal and it does not meet the final plat submittal requirements as prescribed in Ordinance 15-105, specifically pertaining to the requirement that the "Final Plat will have incorporated all changes or modifications required by the council." However, we will consider this submittal adequate to meet your process obligatory deadline to proceed with your final plat review (six month plus extension) to prevent the preliminary plat from being nullified. Should we not see adequate progress within the next 30 days (by June 5, 2011) to meet all conditions, we will then need to further address issues with the final plat submittal timeline obligations. In accordance with Resolution No. 2010-75 regarding the preliminary plat approval, all seven conditions must be met, the most significant outstanding being: Approval of access improvements to the entrance onto Brooklyn Boulevard and the 715t Avenue signalized intersection. Approval of the 71st Avenue street realignment. The above mentioned public improvement requirements must be designed and approved to ensure adequate easement is being dedicated. Referencing the attached memo dated April 13, 2010, items 1, 2, 3, 11, 12, 13, 14, 19 and 20 must also be met prior to commencing preparation of the City Engineer's report on the final plat. Additionally, we need the following: 1.Updated (within the past 30 days) certified abstract of title or registered property report for review. 2.Request for easement vacation and legal descriptions of all easements that must be vacated. 3. Provide a "working plan" with the final plat including all easements, existing utilities, existing topography, buildings, proposed roadway elements, etc. - All proposed and existing features that are relavent must be included so we can verify that indeed the final plat matches everything that is proposed. All other conditions of approval not specifically mentioned are still requirements, but aren't necessarily needed to proceed with the final plat approval and will be addressed prior to final plan approval and building permit issuance. Once the above mentioned obligations have been met, we will then officially start the 60 day requirement of the final plat review/action period. Until then, we are not proceeding on this end with any review as the submittal is incomplete as indicated. B.A minimum 10-ft wide drainage and utility easement along the perimeter boundary of the plat. 2.Legal descriptions must be obtained for all existing easements, which must be vacated as part of the subdivision and site re-development process. 3.An updated certified abstract of title or registered property report must be provided to the City Attorney for review at the time of the final plat application (within 30 days of release of the final plat). 4. The proposed subdivision plat is located adjacent to County State Aid Highway (CSAH) 152. Minnesota Statutes require that the City submit the plat to the Hennepin County Transportation Planning Division for written comments and recommendations. This agreement must also include provisions by the applicant to develop, design and construct the public roadway and utility improvements required for 71 " Avenue and the intersection of 71 " Avenue and Brooklyn Boulevard, all subject to the approval of the City and the County. Should the developer desire the City to provide these improvements, a petition and waiver must be provided by the applicant petitioning the City to provide the needed public roadway and utility improvements along with a waiver of assessment for 100 percent of the costs for the public improvements. These costs will be the full responsibility of the applicant/property owner. Boundary Survey 8.Show sewer and water services for 4813 and 4819 71 " Avenue. 9.On 6" DIP water service, verify and show on the plan whether the gate valve is on the hydrant side of the watermain or the building side of the watermain. 10.Show trees marked for protection shown on L3 and have these located by a surveyor. 11.Verify if vault at SE corner of 4813 is a fiber optic line. Preliminary Plat 11.The proposed R/W for 71st Avenue for the preliminary plat must be developed off of survey topography (not an aerial). This means that the preliminary roadway geometries, alignments, plans, etc. must be developed accurately enough to establish the proposed R/W so the parking and building setbacks are accurate. The R/W will need to be 30-ft minimum from centerline including through the south leg of the intersection. All of these items need to be verified and completed prior to approving the preliminary plat. 12.Provide streetscape easement beyond the R/W in the SW quadrant of the intersection and along the south boulevard to ensure enough City easement for the streetscaping and sidewalk elements. (Note easement vs. dedicated RIW - the difference is that the setbacks are based off of the property line (R/W) and not an easement). 13.Parking lot must be revised so it does not encroach into the setback. 14.Sidewalk with boulevard should be extended on both sides of the northerly private driveway into the site to provide pedestrian connectivity. These conditions are only preliminary and final comments will be developed upon receipt and review of a complete final plat submittal. 1.All requirements from the preliminary plat review as indicated in the April 13, 2011 Public Works memorandum must be completed before the final plat can be reviewed and considered for approval. 2.The easement vacations are scheduled to be held at the June 27, 2011, Council meeting. The vacations will be contingent on the approval of the final plat. If a public easement is to remain, the easement must be shown on the final plat with recorded document number referenced. All easement requirements must be completed before the final plat is considered. 3.A stormwater facilities easement agreement must be executed as a condition of approval for the release of the final plat. 4.Cross Utility agreement is required for sanitary sewer from MB 2 to connection in 71St Avenue. 5.Cross access agreement including the apartment complex to the south is required through the site from 718t due to the limitation of the ¼ intersection on Brooklyn Boulevard. 6.Reiterating a specific comment from the April 13, 2011 memo, there must be a 10' drainage and utility easement along the external property boundary in its entirety, including the west property line along the parking ramp. 7. Prior to Issuance of Land Alteration. The developer may submit one itemized letter of credit, if approved by City staff. The City will not release or reduce the letters of credit or cash escrow until work has been completed according to the final site plans approved by the City. 17.Submit a construction management plan. The plan must be in a City approved format and outline minimum site management practices and penalties for non-compliance. 18. Submit a separate cash escrow for the construction management plan elements in an amount approved by the City staff. This escrow must be accompanied by a document prepared by the City attorney and signed by the developer and property owner. Through this document, the developer and property owner will acknowledge: A.The property will be brought into compliance within 48 hours of notification of a violation of the construction management plan, other conditions of approval or City code standards. B.If compliance is not achieved, the City will use any or all of the escrow dollars to correct any deficiency and/or issue. 19. Schedule and hold a preconstruction meeting with the City staff. 20. Public improvements are required as part of the approval of this project. These costs are the full responsibility of the applicant/property owner. The developer must provide a separate petition and waiver of assessments to the City to perform any necessary public improvements including all associated fees. D.Inspection of the public improvements must be performed by a certified inspector hired directly by and through the City. The developer is required to provide reimbursement to the City for all associated inspection and management expenses. E.The City will only reduce or release the letter of credit or cash escrow for the public improvements upon receipt of as-built drawings and a letter certifying that the streets and utilities have been completed according to the plans approved by the City. F.Upon project completion, the design/project engineer must provide a final topography as-built survey, as-built record drawings of all public improvements and formally certify through a letter that the project was built in conformance with the approved plans and under the design/project engineer's immediate and direct supervision. The engineer must be certified in the state of Minnesota and must certify all required as- built drawings as determined by the City Engineer. Provide a "working plan" with the final plat including all easements, existing utilities, existing topography, buildings, proposed roadway elements, etc. - All proposed and existing features that are relavent must be included so we can verify that indeed the final plat matches everything that is proposed. All other conditions of approval not specifically mentioned are still requirements, but aren't necessarily needed to proceed with the final plat approval and will be addressed prior to final plan approval and building permit issuance. Once the above mentioned obligations have been met, we will then officially start the 60 day requirement of the final plat review/action period.
