RESOLUTION NO. 2020-076
RESOLUTION APPROVING SUMMARY PUBLICATION FOR ORDINANCE 2020-05;
WHEREAS, the City Council of the City of Brooklyn Center has adopted the above
referenced ordinance vacating a portion of right-of-way of Brooklyn Boulevard; and
WHEREAS, Minnesota Statutes, section 412.191, subdivision 4 allows publication
by title and summary in the case of lengthy ordinances or those containing maps or charts; and
WHEREAS, the City Council believes that the following summary would clearly
inform the public of the intent of Ordinance 2020-05.
NOW, THEREFORE, BE IT RESOLVED that: the following summary of Ordinance
2020-05 shall be published in the official newspaper in lieu of the entire ordinance.

An Ordinance Amending Chapter 4 of the City Code of Ordinances Regarding Water
Conservation Restrictions
The City of Brooklyn Center finds that water conservation is critical to the City's welfare and
to the efficient and economical provision of safe water. Under the sole discretion, the city shall
enforce restrictions on the use of water outside of any residence or business, including use of private
water supplies to the extent allowed by state law, other than on permitted days and hours.
Level 1 usage is the default water use restriction level and does not impose any specific
restriction on the use of outside water except for the restrictions established under Section 4-202
including but not limited to, the even -odd sprinkling ban from May 1 to September 30 each year.
Level usage is the use of water outside of a residents or business, regardless of the source.
This ordinance defines the parameters for watering lawns, watering shrubs, flowers or new lawns,
other outside water use, and business use.
Level outside water is permitted as listed in Level 2, except the Public Works Director shall
set the days and hours of permitted use. No recreational use of outside water is permitted and the
Public Works Director may revise increased use permits issued for businesses when Level 3
restrictions are imposed.
Level a total ban is imposed on the use of all outside water within the City except the Level
2 exceptions continue to be allowed. No recreational use of outside water is permitted and the Public
Works Director may revise increased use permlLs issued for businesses when Leve14 restrictions are
imposed.
Based on the level of protection of the public water supply, the Public Worlcs Director may
raise the water use restriction to Level 2, Level 3 or Level 4, dependent upon water availability. All
residents will be notified of the upgraded restriction level and posted at City Hall, on the City's
website and other efforts will be made to inform the public of the upgraded restrictions.
Anyone violating this ordinance will be subject to a surcharge for water service. There is an
appeal process in the same manner, and subject to the same restrictions, established for appealing an
administrative citation under Sections 18-206 tluough 18-209.

and upon vote being taken thereon, the following voted in favor thereof:
Butler, Elliott, Graves, Lawrence -Anderson, Ryan
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
