HomeMy WebLinkAbout2021-039 CCRMember Ryan introduced the following resolution and moved its adoption: RESOLUTION NO.2021-39 RESOLUTION ESTABLISHING A MORATORIUM ON TOWING VEHICLES DURING A SNOW EMERGENCY WHEREAS, Section 27-120(2) of the Brooklyn Center City Code prohibits parking on public streets during a declared snow emergency (2.5 inches of snow or more) and indicates vehicles parked in violation of the prohibition may be towed as provided Section 27-121; and WHEREAS, the City remains under a state and locally declared emergency due to the COVID-19 pandemic and the Mayor has issued emergency proclamations under Section 31-210 to prohibit towing during a snow emergency to avoid adding to the financial impacts of those who are already suffering from the devastating effects of the pandemic; and WHEREAS, the City Council agrees with the Mayoral proclamations and desires to further the policy direction embodied in them by establishing a moratorium on towing; and WHEREAS, the City Council is considering its options regarding the snow emergency provision, including whether to adopt an ordinance to amend the provision, but agrees the towing of vehicles during a snow emergency should be suspended during the pandemic and while it continues to consider its policy options regarding towing; and WHEREAS, adopting this moratorium allows the City staff to plan accordingly and to communicate this temporary prohibition to the City's towing contractor and the public. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Brooklyn Center as follows: 1. A moratorium is established on towing of vehicles from public streets by the City during a snow emergency under Section 27-120(2). 2. This moratorium does not prohibit the City from towing vehicles for any lawful reason other than a violation of the snow emergency provision. 3. This moratorium is effective immediately and shall continue until the statewide emergency declaration related to the pandemic ends, or the effective date of an ordinance amending Section 27-120(2), whichever occurs first.
