HomeMy WebLinkAbout2021-048 CCRMember Butler introduced the following resolution and moved its adoption: RESOLUTION NO. 2021-48 CITY OF BROOKLYN CENTER, MINNESOTA A RESOLUTION ENACTED PURSUANT TO MINNESOTA STATUTES, SECTION 12.29 EXTENDING THE PERIOD OF A MAYOR -DECLARED LOCAL EMERGENCY WHEREAS, the Mayor of the City of Brooklyn Center, Minnesota ("City") issued an emergency proclamation pursuant to his authority under Section 31-210 of the Brooklyn Center City Code ("Code") imposing a curfew from 1:00 a.m. to 6:00 a.m. on April 12, 2021 because of the civil unrest that occurred as a result of an officer -involved shooting that occurred within the City on April 11, 20219 and WHEREAS, the civil unrest resulted in clashes with the police and significant damage to several businesses in the City; and WHEREAS, the Governor authorized the use of the Minnesota National Guard and the Minnesota Department of Public Safety authorized the use of State Patrol to aid the City in responding to the emergency; and WHEREAS, due to the potential for further civil unrest, in order to protect the public health, safety, and welfare the Mayor issued Mayoral Declaration No. 2021-I declaring the existence of a local emergency effective as of April 12, 2021; and WHEREAS, the City Council agrees with the Mayor's declaration and further finds that the local emergency will likely last for more than three days, and that immediate action to respond to the local emergency is needed in order to protect the health, safety and welfare of the City and its businesses; and WHEREAS, Section 2.06 of the Brooklyn Center City Charter provides that in "time of public danger or emergency the Mayor may, with the consent of the Council, take command of the police, maintain order and enforce the law"; and WHEREAS, the City Council finds that consenting to the Mayor's exercise of the Charter authority in this time of public danger and emergency is appropriate for the period of this local emergency as set out in this Resolution; and WHEREAS, Minnesota Statutes, sections 12.29 and 12.37 authorize the actions taken in this Resolution. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Brooklyn Center as follows: RESOLUTION NO. 2021-46 1. The City Council supports the Mayor's Declaration of a local emergency, which shall be continued in effect until May 31, 2021, unless it is revoked earlier by further action of the City Council. 2. Notwithstanding the typical command structure, the City Council consents to the Mayor taking command of the police and taking such other actions as are needed to maintain order and enforce the law in response to the civil unrest. 3. The Mayor may issue additional emergency proclamations as provided in the Code during the period of this local emergency, including imposing further curfews of establishing additional regulations as may be needed to respond to the local emergency. 4. The Mayor, City Manager, City staff, City attorney, and City consultants are authorized and directed to take any and all additional steps and actions necessary or convenient in order to accomplish the intent of this Resolution. � 12.2021 Date � Mayor r ATTEST: City Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Graves and upon vote being taken thereon, the following voted in favor thereof: Butler, Elliott, Graves and the following voted against the same: Lawrence -Anderson, Ryan whereupon said resolution was declared duly passed and adopted.
